Terms of Service

1. Acceptance of Terms

By accessing or using Branofy's AI lead qualification platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including businesses and individuals who access the platform.

2. Description of Service

Branofy Lead Navigator is a subscription platform combining an AI CRM with optional AI agent packs (Pre-Sale, Inbox, and Automation) and add-on packs for calling minutes, AI replies, and extra agent seats. It includes AI voice calling, WhatsApp automation, conversational AI, lead scoring, and a real-time dashboard. Plans are available as Starter, Growth/Pro, and Enterprise, billed monthly or annually.

3. Account & Subscription

Every new account begins with a 10-day free trial of the AI CRM. No credit card is required and no plan is selected at signup. The trial does not include the Pre-Sale, Inbox, or Automation agents, Meta CAPI, or the media library. Upgrading at any point, during or after the trial, begins your first billing cycle. You are responsible for maintaining the security of your account credentials.

4. Pricing & Billing

Subscription fees are billed per billing cycle in advance, monthly or annually, according to the plan and agents you select. Annual billing is offered at a discount to the equivalent monthly rate. There is no setup fee and no minimum contract term; the platform and each AI agent may be cancelled independently at any time.

Add-on packs are billed separately and carry a fixed validity period: AI calling minutes expire 30 days after purchase and do not roll over, and AI reply packs expire at the end of the billing month. Extra agent seats are billed monthly alongside the platform fee.

Upgrades take effect immediately and are pro-rated where the payment gateway supports it. Downgrades and agent removals take effect from the start of the next billing cycle. Refunds and cancellations are governed by our Refund Policy. Enterprise plans follow the terms of their signed SLA where those differ.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose, to send spam or unsolicited communications, to misrepresent your identity or business, or to interfere with the Service's infrastructure. Branofy reserves the right to suspend or terminate accounts that violate these terms.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all lead data processed through the platform. Branofy processes data solely for the purpose of providing the Service and does not sell or share your data with third parties.

7. AI Disclaimer

The AI voice agent and chatbot are automated systems. While designed to accurately qualify leads, AI responses may occasionally be imperfect. Branofy is not liable for any business decisions made solely based on AI qualification results. We recommend human review for high-value deals.

8. Limitation of Liability

Branofy's total liability for any claim arising from the Service shall not exceed the total subscription fees you have paid during the 12 months preceding the claim. Branofy is not liable for indirect, incidental, or consequential damages including lost profits, lost leads, or business interruption.

9. Termination

You may cancel the platform or any individual agent at any time. Cancellation stops the next billing cycle; you retain access to what you have already paid for until the end of the current cycle. There are no notice periods or exit fees. Branofy reserves the right to terminate accounts that violate these terms with reasonable notice.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
